Three things you need to know to fight abortion in 2023
There is a lot of confusion out there about where we are at in the fight for LIFE right now.
On the one hand, even with Roe out of the way, our goals really haven’t changed. We want all babies (whether in or out of the womb) to be equally protected by law in the same way the rest of us are protected.
On the other hand, many headlines make it sound like abortion has been abolished and the fight is over.
Well, the fight isn’t over in Texas (or anywhere else, really). Here are three critical things you need to know about the battle against abortion in 2023.
1. Texas is NOT down to only 10 abortions per month.
It is true that REPORTED abortion numbers in Texas are very low since the Dobbs decision (approx. 10 in one recent month). These are numbers gathered from clinics and practitioners within the traditional medical system.[1]
What you may not know is that REPORTED abortion numbers are not the same as ALL abortions.
Increasing numbers of abortions are committed by self-induced (a/k/a self-managed) abortion methods.[2] Self-managed abortions are committed outside the traditional medical system and are UNREPORTED.
Unfortunately, because state lawmakers have refused to pass the Abolition of Abortion in Texas Act for the last three sessions, it is not illegal in Texas for a woman to self-manage her own abortion at home, and many women are doing it by ordering medication abortion pills online.
2. Abortion is not yet abolished in Texas.
Under current Texas law, it is illegal in nearly all cases for medical personnel to perform abortion procedures or prescribe medication abortion drugs to patients. These types of abortions make up all of the reported abortion numbers, which is why the numbers of reported abortions have dropped so dramatically since the overturn of Roe.
The Dobbs decision triggered stricter abortion laws in many states, including Texas.
But abortion is not illegal for everyone in Texas.
It is currently illegal for a doctor or medical practitioner generally to abort a baby in Texas.
But it is not illegal for a woman to murder her own baby by abortion at any time up to birth in Texas.
Nearly every Pro-Life law currently in place actually carries an exemption to ensure that mothers are not subject to the law when they abort their own babies.
Here’s what that looks like in the Texas trigger law, HB 1280:

And just about every other Pro-Life law in Texas or any other state contains a similar exemption for mothers to ensure that they are not subject to the law.
3. Preborn babies are still being DENIED equal protection in all 50 states.
For decades, Pro-Life politicians, lobbyists, and legislators have been creating laws that simply do not get to the root of the problem.
Laws have been enacted to regulate:
- Particular methods of killing
- Where the killing may be done
- Who may be killed
- Who may do the killing
- And even what to do with the body of the victim
But none of these laws treat preborn babies as equally valuable to born people. We can tell this immediately because none of these laws even fall under the homicide code.
Even the supposed “near total abortion bans” enacted in many states since Dobbs only make it illegal for SOME people to kill babies by abortions. These laws don’t apply to all people equally.
The answer is equal protection.
Equal protection isn’t about creating a complex system of new laws. We don’t need new laws.
Equal protection just removes the exception for abortion from our homicide code and protects preborn babies in the same way born people are already legally protected from murder.
It’s not complicated.
In fact, it’s quite simple.
We don’t have to figure out every possible method that someone may ever use in the future to murder a baby or exactly who might do it. Pro-Life laws have been trying to do that for fifty years and look how that’s turned out. We now have “abortion bans” that still allow moms to kill their own babies as long as they do it at home.
No, we need to reject that worldly-wise strategy and instead do what God commands and the U.S. Constitution requires: love our neighbors as ourselves by providing the equal protection of the laws to all people, including preborn people.
Equally protect preborn babies with the same homicide laws that legally protect the rest of us from all forms of murder.
No more compromise. No more delay.
