HB 3641 – Declaring Roe v. Wade unconstitutional in Texas

Exciting news!

Rep. Bryan Slaton is bringing a SECOND bill declaring Roe v. Wade unconstitutional in Texas, encouraging current Texas laws against abortion to be enforced!

And Senator Bob Hall is bringing an identical companion bill in the Senate, dramatically increasing the chances of advancing this vital legislation.

This is HB 3641 in the House, and SB 1671 in the Senate. The same wording, brought in both chambers of the Legislature simultaneously.

HB 3641/SB 1671 both assert the authority of the state of Texas, and they directly challenge the 1973 Roe v. Wade ruling because it is an unconstitutional act of an out-of-control federal government.

Roe v. Wade has claimed to authorize the death of millions of babies over the last 48 years, and HB 3641/SB 1671 will remove the ability for Roe to continue taking the lives of preborn citizens in Texas.

Under current Texas state law, abortion is already a crime. It is already illegal to kill a child in the womb! But due to an Attorney General opinion from the mid 1970’s, these laws are not being enforced.

This is wrong, and there is a new wave of understanding that it is past time to stand up to the federal government and enforce state law. HB 3641/SB 1671 does just that!

Here’s what’s in the bill, and also, why it’s important that you contact your state senator and representative and ask them to co-author both the House and Senate version:

First, HB 3641/SB1671 asserts the sovereignty of the state of Texas. Texas is only subject to the U.S. Constitution, and its freedom is preserved by the constitutional exercise of local government. The Supreme Court does not create laws for the state of Texas, and it’s time to set up a full challenge to an out-of-control federal government from almost 50 years ago!

Second, the Texas Constitution states that all political authority is derived from the people, and “No citizen of this State shall be deprived of life, liberty, property, privileges or immunities, or in any manner disfranchised, except by the due course of the law of the land” (emphasis added). This reaffirms the importance of protecting the life of every individual in Texas, including our preborn babies. Every child deserves life and liberty, inside and outside of the womb.

Third, HB 3641/SB1671 explains that “though prudence dictates that states should not declare actions of the federal judiciary void for light or indefinite causes, the legislature does not concede that the federal judiciary is infallible nor its powers unlimited” and that “nothing in the United States Constitution provides for a right to abortion of preborn human beings.” In other words, this bill does not flippantly disregard rulings from the Supreme Court, but declares Roe a disastrous and wrongful ruling.

This is in full agreement with members of the Supreme Court like Justice Clarence Thomas, who recently stated:

The Constitution does not constrain the States’ ability to regulate or even prohibit abortion. This Court created the right to abortion based on an amorphous, unwritten right to privacy, which it grounded in the ‘legal fiction’ of substantive due process.

This is exactly what HB 3641/SB 1671 does.

Dear Senator/Representative [Last Name],

I am writing to ask that you co-author and vote for HB 3641 and SB 1671. Please give your full support to this legislation to overturn unconstitutional court rulings and assert the authority of the Texas Constitution.

The Texas Constitution explicitly states that ALL life is to be protected, and passing these bills will recognize that preborn Texans have the right to life.

In addition, current state law already provides some protections for the preborn. These should be enforced!

Please take action today.
